These Terms and Conditions apply to bookings, enquiries and travel services made through gorilla-trek.com, by email, telephone, social media, in person or through any other channel operated by Gorilla Trek.
Gorilla Trek is a brand operated by Adventure Out Loud Pty Ltd (ABN 85 124 320 529) of 1207 Kangdanga Creek Rd, Kandanga, Queensland, Australia, 4570. In these Terms and Conditions, “we”, “us”, “our” and “Gorilla Trek” mean Adventure Out Loud Pty Ltd.
By making an enquiry, requesting a quotation, paying a deposit or balance, or otherwise confirming a booking with us, you agree to these Terms and Conditions.
If you are booking on behalf of another traveller or travellers, you confirm that you have authority to accept these Terms and Conditions on their behalf.
1. Important information
Gorilla trekking and other wildlife adventures can involve remote locations, difficult terrain, altitude, extreme weather, wildlife encounters, limited medical facilities, long driving distances and changes to itinerary.
Travel arrangements may be affected by weather, wildlife movements, local conditions, road conditions, government requirements, conservation rules, park closures, illness, security events, airline disruption, supplier changes and other circumstances outside our reasonable control.
You should read these Terms and Conditions carefully before booking. You should also read:
-
Your quotation or booking confirmation.
-
The itinerary and inclusions and exclusions.
-
The applicable terms of airlines, accommodation providers, local operators and other suppliers.
-
Any travel advisories relevant to your destination.
-
Your travel-insurance policy.
If there is an inconsistency between these Terms and Conditions and a specific written term in your booking confirmation, the booking confirmation will apply to the extent of that inconsistency.
2. Our role
We may act in one or more of the following capacities:
-
As a provider of services we operate directly.
-
As an agent arranging services supplied by third parties.
-
As a package organiser combining services supplied by us and third parties.
-
As an intermediary facilitating a contract between you and a third-party supplier.
Your booking documents will identify, where reasonably practicable, the principal suppliers involved in your travel arrangements.
Where a service is supplied by a third party, that service may be subject to the third party’s own conditions of carriage, booking conditions, cancellation terms, safety procedures and limitations of liability.
We will use reasonable care and skill in arranging services and communicating relevant information to you. Nothing in these Terms and Conditions makes us responsible for a third-party supplier’s acts or omissions where we are acting only as an agent, except to the extent required by law.
3. Quotations and availability
A quotation is an invitation to book and is not a confirmed booking unless we confirm otherwise in writing.
Prices and availability may change before a booking is confirmed because of:
-
Supplier availability.
-
Currency fluctuations.
-
Airfare changes.
-
Permit availability.
-
Government taxes or charges.
-
Park, conservation or accommodation fees.
-
Changes requested by you.
-
Errors or omissions in the quotation.
A quotation will remain valid until the expiry date stated in it. If no expiry date is stated, it will remain valid for 30 days, subject to availability.
We reserve the right to correct an obvious pricing or description error before confirming a booking. If an error affects a booking already paid for, we will contact you and provide the options required by applicable law.
4. Booking confirmation
A booking is confirmed when:
-
We have accepted your booking in writing;
-
Required traveller information has been provided;
-
The required deposit or full payment has been received; and
-
Required permits or supplier confirmations have been obtained or are being processed.
We will issue a booking confirmation setting out the booked services, price, payment schedule and any special conditions.
A booking may not be confirmed until we have verified the availability of permits, accommodation, transport, flights or other essential services.
5. Prices and currency
Unless stated otherwise, prices are in Australian dollars and include only the items expressly listed as included in your quotation or booking confirmation.
Unless expressly included, prices do not include:
-

Any mandatory taxes, levies, park fees, permit fees or government charges known to us at the time of quotation will be identified as clearly as reasonably practicable.
6. Deposits and payment
The deposit and payment schedule will be stated in your quotation or booking confirmation.
Unless a different amount is stated:
-
A deposit of $2,500 per person is required to confirm the booking.
-
The remaining balance is due 90 days before departure.
-
Bookings made within 90 days of departure must be paid in full unless we agree otherwise in writing.
Some services, including gorilla permits, chimpanzee permits, flights, accommodation and special events, may require earlier payment or may be non-refundable once purchased.
If payment is not received by the due date, we may, subject to applicable law:
-
Send a payment reminder.
-
Suspend the booking.
-
Cancel the booking.

We are not required to hold availability or permits until the required payment has been received.
7. Payment methods and card surcharges
We accept the payment methods shown at the time of booking.
A payment-processing or card surcharge may apply where disclosed before payment. Any surcharge will not exceed our reasonable cost of processing the relevant payment, where applicable law imposes such a restriction.
You must not initiate a chargeback or payment reversal without first contacting us and giving us a reasonable opportunity to investigate the issue, except where your card provider’s rules or applicable law require otherwise.
8. Traveller information
You must provide accurate and complete information for every traveller, including where relevant:
-
Full name as shown on the passport.
-
Date of birth.
-
Nationality and residency.

Any other information reasonably required by us or a supplier.
You are responsible for checking all names and details in your booking confirmation and notifying us promptly of any error.
We are not responsible for costs resulting from inaccurate, incomplete or late information supplied by you, including denied boarding, denied entry, incorrect permits, missed services or name-change charges.
We will handle personal information in accordance with our Privacy Policy.
9. Passports, visas and entry requirements
You are responsible for obtaining and carrying:
-
A valid passport.
-
Any required visas.
-
Entry permits.
-
Transit visas.
-
Vaccination certificates.
-
Yellow-fever certificates or other health documentation.
-
Any other documents required for your nationality, itinerary and destination.
Passport and visa requirements can vary by nationality and may change. You should confirm requirements with the relevant embassy, consulate, government authority or official travel-advice service.
Your passport must meet the validity and blank-page requirements of every country you visit or transit through.
We may provide general information about passports, visas and entry requirements, but we do not guarantee that the information is current, complete or applicable to your particular circumstances.
You are responsible for any loss, cost or disruption caused by failing to meet entry, transit, vaccination or documentation requirements.
10. Health and medical requirements
You must assess whether the trip is suitable for your health, fitness and medical circumstances.
You should obtain medical advice before travel, especially if you:
-
Have a pre-existing medical condition.
-
Take prescription medication.
-
Are pregnant or recently gave birth.
-
Have mobility, respiratory, cardiovascular or immune-system concerns.
-
Have allergies.
-
May be affected by altitude, heat, humidity or strenuous activity.
-
Require regular medical treatment.
-
Have concerns about trekking, climbing, long drives or remote travel.
Some activities may involve steep, uneven, muddy or slippery terrain, long periods of walking, high humidity, altitude, limited facilities and physically demanding conditions.
You must inform us before departure about any condition, medication, allergy, dietary requirement, disability, mobility limitation or other circumstance that may affect your safety or the safe operation of the trip.
We may request reasonable medical information or a medical clearance where necessary for safety or supplier requirements. We will handle health information in accordance with our Privacy Policy and applicable law.
A failure to disclose relevant information may affect our ability to provide the services safely and may result in changes to, or cancellation of, your participation.
11. Gorilla permits and wildlife permits
Where your itinerary includes a gorilla, chimpanzee or other wildlife permit, the permit is subject to the rules of the relevant authority and destination.
Permit conditions may include:
-
Fixed dates.
-
Named travellers.
-
Non-transferability.
-
Non-refundability or limited refundability.
-
Health requirements.
-
Minimum age requirements.
-
Group-size restrictions.
-
Time limits.
-
Distance restrictions.
-
Rules about illness, including infectious illness.
-
Rules about behaviour, photography and proximity to animals.
We will communicate the permit conditions available to us. You must comply with the rules of the relevant park, conservation authority, guide and local operator.
The availability, price and refundability of permits are controlled by the relevant authority or supplier. A permit may be non-refundable even where you cancel, are unable to travel, fail to meet entry requirements, arrive late or are unable to participate for health or other personal reasons.
If a relevant authority cancels, changes or restricts a permit, we will discuss the available options with you. Those options may include rescheduling, substitution, an amended itinerary, a credit or a refund, subject to the authority’s rules and applicable law.
12. Wildlife and outdoor activity risks
Wild animals are unpredictable and sightings are not guaranteed.
You must follow all instructions given by guides, rangers, park authorities, drivers and accommodation staff. You must not:
-
Approach, touch, feed or attempt to attract wildlife.
-
Leave an authorised vehicle or trail without permission.
-
Separate from the group without permission.
-
Ignore a safety instruction.
-
Use a flash where prohibited.
-
Use drones where prohibited.
-
Make excessive noise or interfere with wildlife.
-
Carry prohibited items.
-
Engage in conduct that puts you, another person, a guide or wildlife at risk.
We may refuse or end participation in an activity if we reasonably consider that a person’s conduct, health, fitness, intoxication or equipment creates a safety risk.
Wildlife sightings, trekking duration, route, distance and conditions may change without compensation where the change is reasonably required for safety, conservation, animal welfare, park rules or operational reasons.
13. Travel insurance
Comprehensive travel insurance is strongly recommended and may be mandatory for some trips or suppliers.
Your policy should cover, as appropriate:
-
Overseas medical expenses.
-
Emergency evacuation and repatriation.
-
Cancellation and amendment costs.
-
Curtailment.
-
Missed connections and delays.
-
Lost, stolen or damaged baggage.
-
Personal liability.
-
Adventure activities and trekking.
-
Pre-existing medical conditions.
-
Permit and supplier cancellation charges.
-
Natural disasters, epidemics and travel disruptions.
You must check that your policy covers gorilla trekking, hiking, remote travel, altitude, wildlife activities and any other activity included in your itinerary.
We are not an insurer and do not determine whether a claim is covered. You are responsible for making any insurance claim and supplying the insurer with the requested documents.
14. Changes requested by you
You may request changes to your booking by contacting us in writing.
A change is not effective until confirmed by us in writing.
Changes may result in:
-
Supplier change fees.
-
Airline fare differences.
-
Permit reissue or replacement costs.
-
Accommodation charges.
-
Cancellation charges.
-
Administration fees.
-
Transport costs.
-
A change to the itinerary or price.
We will tell you about known costs before proceeding where reasonably practicable.
Some changes may not be possible after confirmation, including changes to traveller names, permit dates, accommodation, flights and departure dates.
15. Cancellation by you
You may cancel your booking by contacting us in writing. Cancellation takes effect when received and acknowledged by us, subject to our ability to verify the request.
Unless your booking confirmation states different supplier terms, the following cancellation schedule applies to the land arrangements arranged by us:
| Cancellation received | Cancellation charge |
|---|---|
| More than days before departure | Deposit and all non-refundable supplier charges |
| [90–120] days before departure | % of the total booking price plus non-refundable supplier charges |
| [60–89] days before departure | % of the total booking price plus non-refundable supplier charges |
| Less than days before departure or no-show | % of the total booking price |
The applicable cancellation amount must reflect the terms disclosed to you and the reasonable costs, losses and charges incurred in connection with your booking. We will not rely on a cancellation charge to the extent it is unenforceable or prohibited by law.
Airfares, permits, insurance premiums, visa fees, payment fees and other specified non-refundable charges may be subject to separate cancellation terms.
If you cancel because of illness, injury, a change in personal circumstances, a government advisory, inability to obtain a visa, fear of travel or another personal reason, the applicable cancellation terms still apply unless a different entitlement arises under applicable law or your booking confirmation.
You should contact your travel insurer promptly if the cancellation may be covered.
16. Cancellation or changes by us
We may need to cancel or change a booking before departure because of:
-
Supplier failure or insolvency.
-
Permit unavailability.
-
Changes imposed by a park or government authority.
-
Security concerns.
-
Weather or environmental conditions.
-
Natural disaster.
-
Epidemic or pandemic.
-
Political unrest.
-
Transport disruption.
-
Operational requirements.
-
Low participation.
-
Force majeure.
-
An event that makes the trip unsafe, unlawful or impracticable.
Where we make a significant change or cancel a service, we will notify you as soon as reasonably practicable and discuss available options.
Depending on the circumstances and applicable law, options may include:
-
Accepting the changed itinerary.
-
Accepting a comparable alternative.
-
Accepting a different departure date.
-
Receiving a credit.
-
Receiving a refund of amounts to which you are legally entitled.
A credit will not be offered instead of a refund where applicable law requires a refund.
If a third-party supplier cancels or fails to provide a service, the available remedy may depend on the supplier’s terms, the nature of our role and applicable law. We will take reasonable steps to assist you and communicate relevant options.
We will not cancel or substantially change a booking to avoid an obligation that cannot lawfully be excluded.
17. Force majeure
“Force majeure” means an event beyond our reasonable control that could not reasonably have been prevented or avoided and that affects the provision of the services.
Examples include:
-
Natural disasters.
-
Severe weather.
-
Flood, fire or earthquake.
-
Epidemic or pandemic.

-
Transport failure.
-
Supplier insolvency.
-
Park, conservation or permit restrictions.
-
Serious security threats.
-
Power, telecommunications or infrastructure failure.
Where a force-majeure event affects your booking, we will act reasonably and in good faith. We may offer a change, alternative service, postponement, credit or refund depending on the circumstances, supplier recoveries and applicable law.
Nothing in this clause limits your rights under the Australian Consumer Law.
18. Itinerary changes during travel
The published itinerary is an indication of the planned arrangements and may change.
We may make reasonable changes to:
-
Routes.
-
Accommodation.
-
Transport.
-
Guides.
-
Activity timing.
-
Trekking locations.
-
Wildlife areas.
-
Order of activities.
-
Meal arrangements.
-
Excursions.
-
Group composition.
We will endeavour to maintain the overall nature, standard and value of the trip.
Changes may be required because of weather, road conditions, wildlife movements, park restrictions, conservation requirements, illness, safety, operational requirements or events outside our reasonable control.
If a change materially reduces the value of the services you purchased, we will discuss an appropriate remedy required by applicable law.
19. Accommodation
Accommodation descriptions are based on information provided by the relevant property or supplier.
Room type, views, facilities, accessibility, bedding, meal arrangements and services may vary by property and may be subject to availability.
You must comply with the accommodation provider’s rules. You may be responsible for damage, loss, additional cleaning, minibar charges, telephone charges, room-service charges or other expenses caused by you or a member of your group.
Where accommodation is substituted, we will seek accommodation of a comparable standard where reasonably practicable.
20. Transport and flights
Flights and other transport services may be supplied by independent providers and are subject to their conditions of carriage.
You are responsible for:
-
Checking flight details.
-
Arriving at the correct airport or departure point on time.
-
Meeting check-in and baggage requirements.
-
Allowing sufficient time for transfers.
-
Confirming any schedule changes.
-
Paying applicable baggage, seat-selection and change fees.
We are not responsible for costs arising from your failure to meet a carrier’s requirements or a missed connection caused by your own actions.
Where we arrange a separate ticket or transfer, you are responsible for allowing sufficient time between services. We recommend allowing additional time for international connections and possible delays.
21. Conduct and removal from a trip
You must behave respectfully and lawfully and follow reasonable instructions from us, guides, rangers, suppliers and local authorities.
We may exclude you from a service or end your participation without refund if you:
-
Behave aggressively, abusively, unlawfully or threateningly.
-
Harass another traveller, staff member, guide or local person.
-
Are intoxicated or impaired.
-
Damage property.
-
Ignore safety instructions.
-
Put another person or wildlife at risk.
-
Possess prohibited items.
-
Fail to meet a reasonable medical, fitness or safety requirement.
-
Disrupt the group or operation of the trip.
If your participation is ended because of your conduct, you are responsible for all resulting costs, including transport, accommodation, medical care and repatriation.
This clause does not limit any rights you have under applicable law.
22. Children and young travellers
A parent or legal guardian must approve the booking and accept these Terms and Conditions for any traveller under 18 years of age.
You must tell us the age of every traveller before booking.
Some permits, activities, accommodation providers and transport providers impose minimum-age requirements. We cannot guarantee that a child will be accepted for every activity.
A parent, guardian or responsible adult remains responsible for supervising children throughout the trip unless a supplier expressly accepts responsibility.
23. Accessibility and special requirements
We will make reasonable efforts to discuss accessibility and special requirements before booking.
You must provide accurate information about mobility, medical, dietary, sensory, communication or other requirements as early as possible.
Some destinations, vehicles, accommodation and trekking routes may have limited accessibility. Gorilla trekking may require walking on uneven ground and may not be suitable for all travellers.
We will tell you about known limitations and seek reasonable solutions where available. We do not guarantee that every requested arrangement can be provided.
24. Complaints during travel
If a problem occurs during your trip, you should notify the relevant supplier and contact us as soon as possible so that we have a reasonable opportunity to investigate and address it.
You should:
-
Report the problem promptly.
-
Give the supplier or our representative a reasonable opportunity to fix it.
-
Keep records, receipts, photographs and other evidence.
-
Notify us in writing if the problem is not resolved.
If you leave the trip or arrange replacement services without giving us a reasonable opportunity to respond, this may affect our ability to investigate or recover costs, except where immediate action is reasonably required for safety or another urgent reason.
25. Complaints after travel

These guarantees may include that services will be provided:
-
With acceptable care and skill.
-
In a manner fit for any purpose you make known to us.
-
Within a reasonable time where no time is agreed.
If a service does not meet a consumer guarantee, you may be entitled to a remedy, which may include rectification, resupply, refund, cancellation or compensation, depending on the circumstances.
Nothing in these Terms and Conditions excludes, restricts or modifies any right, guarantee, condition or remedy that cannot lawfully be excluded, restricted or modified.
The consumer guarantees may not apply in the same way to every booking, particularly where a person acquires services wholly or predominantly for business purposes and the Australian Consumer Law permits limitation. Any limitation will apply only to the extent permitted by law.

To the extent permitted by law, our liability for a failure to provide services will be limited to supplying the services again or paying the cost of having the services supplied again.
This limitation does not apply where the law does not allow it, including in relation to liability that cannot be excluded or limited under the Australian Consumer Law, personal injury or death caused by our negligence, fraud, or any other liability that cannot lawfully be limited.
28. Indemnity
To the extent permitted by law, you agree to compensate us for reasonable loss, damage, cost or expense resulting from:
-
Your breach of these Terms and Conditions.
-
Your unlawful, reckless or negligent conduct.
-
Damage caused by you to property.
-
Your failure to provide accurate information.
-
Your failure to comply with a supplier’s rules.
-
Costs incurred because you fail to meet travel, health, visa or documentation requirements.
This clause does not require you to indemnify us for loss caused by our negligence, breach of contract or unlawful conduct.
29. Personal property
You are responsible for your passport, money, baggage, electronics, medication, equipment and other personal property.
We recommend that you keep valuables secure and avoid carrying unnecessary items.
If property is lost, stolen or damaged, you should report it promptly to the relevant supplier, local authority, police and insurer.
30. Photography and promotional material
During a trip, we or our authorised suppliers may take photographs or video for operational, safety, promotional or educational purposes.
We will not use an identifiable image of you for promotional purposes without your consent, unless otherwise permitted by law.
You may tell us before or during the trip that you do not consent to promotional use of your identifiable image.
You must respect the privacy of other travellers, local communities, guides, staff and wildlife. You must not publish another person’s identifiable image without appropriate permission.

Website content does not form part of your booking unless expressly incorporated into your booking confirmation.
32. Third-party websites and services
Our website may contain links to third-party websites, booking platforms, payment providers or travel resources.
Those services are operated by third parties and may have separate terms and privacy policies. We are not responsible for the content, availability, security or privacy practices of third-party websites.
You should review the terms applying to any service before using it or providing personal information.
33. Privacy
We collect, use, store and disclose personal information in accordance with our Privacy Policy.
Information may be disclosed to suppliers and service providers where reasonably necessary to arrange or provide your travel. Those suppliers may be located in Australia or overseas.
Information may include identity, contact, passport, emergency-contact, payment, travel, dietary, accessibility and health information where relevant to your booking.
You should not send passport, medical or payment information by ordinary email unless we have specifically instructed you to do so through a secure process.
34. Marketing communications

38. Assignment
You may not transfer your booking or rights under these Terms and Conditions without our written consent and, where required, the consent of relevant suppliers.
We may transfer our rights and obligations to a related entity or successor as part of a business sale, restructure or corporate transaction, provided this does not reduce your rights under applicable law.
39. Severability
If any provision of these Terms and Conditions is invalid, unlawful or unenforceable, it will be read down or severed to the extent necessary, and the remaining provisions will continue to apply.
40. No waiver
If we do not immediately enforce a provision of these Terms and Conditions, that does not mean we have waived our right to enforce it later.
41. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of Queensland, Australia.
The parties submit to the courts of Queensland and the Commonwealth of Australia that have jurisdiction, except where applicable law gives you a right to bring proceedings elsewhere.
Nothing in this clause prevents you from exercising a consumer right or remedy that cannot lawfully be restricted.
